Kaimai Coast Spirit 4 berth - Terms & Conditions

TERMS AND CONDITIONS

Rates/Minimum Hire Periods:
* Rates are per day in NZ$ and include GST (New Zealand Government Tax)
* The minimum hire period is 10 days for unlimited kilometres

Drivers/Licences
All drivers must be at least 25 years old and hold a full and current New Zealand driver's licence, or an International Driving Licence, or a licence from the country of origin with English translation.

Depots/Pickup Points
Depots: Tauranga, Auckland

INSURANCE
Standard Insurance
Basic insurance is included in the daily rate. The hirer is liable for the first NZ$3500 of any damage caused in any one accident. The hirer will be fully liable for the repair or replacement of damaged windscreens and tyres.

Bond
All hirers are subject to a bond of NZ$3500 payable at the commencement of hire. This bond is fully refundable if the vehicle is returned on the due date at the agreed drop off depot in a clean and undamaged condition, with a full tank of fuel and an empty toilet cassette. The hirer is fully liable for the repair or replacement of damaged windscreens or tyres. It is Company policy to deduct the bond from the hirers credit card. Kaimai Coast Rentals will not be responsible for any losses incurred due to interest charges or currency fluctuations.

Insurance Exclusions
Tyres and punctures are not covered by insurance and are to be repaired/replaced at hirers cost. The hirer will be fully liable for any damage to the Kaimai Coast vehicle or Third Party property if:
- The vehicle is driven otherwise than in a cautious, prudent and normal manner
- Used in a manner which could cause damage
- Driven in a prohibited area
- Driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law
- Left with the ignition key in the Vehicle while it is unoccupied
- Damaged by: (i) submersion in water (ii) contact with salt water
- Used for any illegal purpose or in any race, rally or contest
- Used to tow any vehicle or trailer
- Used to carry passengers or property for hire or reward
- Used to carry more persons than is permitted by any relevant Authority or detailed in the Vehicle manual or on the Vehicle
- Used to carry volatile liquids, gases, explosives or other corrosive or inflammable material
- Hirer will be responsible for all damage within the vehicle, except where such damage is a result of a vehicular collision, and only as a result of a vehicular collision
- Otherwise used in breach of my obligations under this Agreement

Note: It is the Hirers responsibility to ensure that a full insurance details are obtained, and to correctly fill out all applicable forms. In the event of an accident or damage involving a third party, if the full and correct and contact details of the additional party(s) are not obtained, the Hirer is liable for the excess amount of the insurance irrespective of who is at fault. In the event of an accident or damage involving a third party, if it is not possible to obtain the excess amount of the insurance from that third party, the Hirer is liable for the excess amount irrespective of who is at fault. Where there is an instance of loss or damage that is not covered by insurance, the amount due by me in respect of any damage arising from that incident loss or damage is payable by me from the date each incident of loss or damage occurred.

Pets
The Hirer will not allow any animals to be carried in, or enter the Vehicle. If any animal has been in the vehicle, it will be deemed to be soiled.

Smoking
The Hirer will not allow any person(s) to smoke in the vehicle at any time. If any person(s) has smoked in the vehicle, it will be deemed to be soiled.

Maintenance and Repair
- Hirer shall take all reasonable steps to properly maintain the Vehicle, including daily checks of the oil, water and batteries, as well as daily checks for damage.
- Kaimai Coast rentals will reimburse the Hirer for expenditure up to NZ$ 100.00 reasonably incurred in rectifying any mechanical failure to the drive train and engine of the Vehicle (provided that prior consent of Kaimai Coast rentals is first be obtained and the damage is not due the fault of the Hirer).
- Hirer will be liable for any cost associated with the incorrect use of fuel (fuel being diesel or petrol).

Change of Vehicle
Kaimai Coast Rentals reserves the right at its absolute discretion, to substitute a comparable or superior vehicle for the Vehicle. In that event the Hirer shall not be liable for any increased rental or other charges save for any additional running costs pertaining to the substitute vehicle. Such substitution shall not entitle the Hirer to any refund and does not constitute a breach of this Agreement

Delivery and Return of Vehicle
The Vehicle will be delivered in a clean condition and in sound working order in accordance with the vehicle condition and stock report and with a full fuel tank. The Vehicle is to be returned in a clean condition and with a full fuel tank and on the return date, time and location set out in the booking confirmation. I acknowledge that I cannot change the return location without the prior consent of Kaimai Coast rentals, and that such an alteration if made after uplifting the Vehicle may incur an additional relocation charge of up to NZ$750.00.

Other Charges
In addition to all rental charges, bond, and/or bond waiver payments, the hirer may also be liable for:
- The nominated cleaning fee if the Vehicle is not returned with the interior in a clean condition
- The nominated additional fee if the toilet and waste water tank (if applicable) are not emptied prior to the return of the Vehicle
- The cost of any damage to the Vehicle or the property of any third party (subject to the Bond or Bond Waiver option)
- All parking fines, other fines or penalties, and/or accidents including third party property damage not reported on return of the vehicle
- Any costs incurred by Kaimai Coast rentals as a result of any breach of the terms of this Agreement
- The cost to retrieve or recover a vehicle which has become bogged, regardless of Excess Reduction taken

Road Restrictions
- Vehicles may only be driven on well maintained roads.
- No vehicle shall be driven on Skippers Road (Queenstown), any Beach, Ball Hutt Rd (Mt Cook) and north of Colville Township (Coromandel Pen.)


General Conditions
The Company reserve the right to make deductions over and above the bond for any of, or multiples of the following:
There will be no refund for vehicle returns before the due date, or unused rental days.
In the event of mechanical failure or major accident rendering the vehicle unserviceable and no alternative vehicle is available, liability will be to only refund those actual lost rental days.

Deposit
A deposit of 20% of the total hire cost is payable to secure a booking. This is calculated on 20% of the daily hire tarrif times the number of days of the hire. The full balance is required 30 days before the commencement of the hire.

The bond and any additional equipment must be paid at the Depot at the commencement of the hire.
