Base Jumper 2 berth - Terms & Conditions

Effective 1 April 2006 - 30 July 2008
To ensure you have a safe and enjoyable trip please take the time to read the following important information:

DEFINITIONS
'Hirer' means the person or persons nominated as the Hirer and any person whose credit card is presented for payment of the Hirer's charges. 'WML' means Wilderness Motorhomes Ltd. 'Vehicle' means the Vehicle hired by the Hirer and includes tyres, tools, accessories, and all other equipment, documents or additional hire items related to the Vehicle and any replacement or substitute Vehicle that may be provided.

DETAILS OF RENTAL
Daily Hire Charges
2.1 - All prices quoted and payable in NZ dollars.
2.2 - Rates include unlimited kilometres and GST.
2.3 - Rental days are calculated on a calendar basis. Part days at the start or end of hire are charged at the daily rate. The day of pick-up is counted as day one of the rental, regardless of the pick-up time. The day the Vehicle is returned is counted as the final full day of the rental regardless of return time.
2.4 - Late pick up or early return of the Vehicle does not entitle the Hirer to any refund of the unused portion of the rental.
2.5 - Terms and conditions as well as rates quoted on our website are subject to change without notice. However, rates or conditions applicable to your rental will not be altered once your booking has been confirmed except because of changes in statutory or regulatory laws or to correct errors made by either party.

Vehicle Equipment
The Vehicle contains the following equipment: crockery, cutlery, cooking utensils, pots, fry-pan, grater, chopping board, salad/serving bowls, storage containers, toaster, kettle, bucket, brush and shovel, duvet, pillows, sheets, towels, tea towels, gas bottles, BBQ, outdoor table & chairs, snow chains, pegs and clothesline.

Rental Package Extension
Extension of hire is subject to availability and confirmation by WML. The cost of the rental extension is to be paid at time of confirmation.

Minimum Rental
Minimum rental period is seven days.

One-way hire fees
There are no one way hire fees.

Extra Driver fees
There are no extra driver fees.

Vehicle availability
If, for reasons beyond our control, the reserved Vehicle is not available, we reserve the right to substitute a Vehicle of similar or better standard. In the event that an alternative Vehicle is unavailable, our liability is limited to refunding your payment for hire days.

INSURANCE AND BOND
Insurance
10.1 - The daily hire charge includes comprehensive insurance cover.
10.2 - A standard excess of $2500 applies in the event of any damage to either the Vehicle or third party property except in the case of the replacement or repair of damaged windscreens and tyres.
10.3 - In the event of any damage to a Vehicle or third party property, a second bond will be collected to cover the excess for any subsequent damage (see clause 12).
10.3 - Accident compensation laws cover personal injury claims but Hirers are strongly recommended to investigate taking full travel insurance for both personal property damage and personal injury, as the statutory scheme is limited in its range of compensatory payments.

Excess Waiver
WML's Zero Excess policy reduces the excess for any damage to either the Vehicle or third party property to NIL. The Hirer acknowledges responsibility for all costs resulting from damage, irrespective of Zero Excess that may have been taken, if they are found to have:
Failed to meet the requirements in clauses 21 - 29.
Damaged the Vehicle by wilful misconduct (e.g. sitting or standing on the roof)
Failed to abide by New Zealand road rules resulting in damage to the Vehicle.
Allowed the Vehicle to become bogged requiring it to be recovered
Lost or had the keys stolen
Damaged the under body of the Vehicle, however caused
Driven on Ninety Mile Beach


Bond
12.1 - A bond of NZ$2500 is required on collection of the Vehicle
12.2 - The bond can be reduced to NZ$500 with the purchase of Zero Excess.
12.3 - The bond is fully refundable if, at the time of Vehicle return, the following conditions have been satisfied: the Vehicle is returned to the agreed location on the agreed date; the Vehicle is returned in a reasonably clean and tidy condition; no items are lost or damaged; all holding and waste tanks are empty; and the Vehicle has not been damaged or involved in an accident (see clause 20). The bond will be reduced rateably and proportionally to allow for WML to put the vehicle and/or its contents back in the same condition it was when it was picked up.
12.4 - All payments will be on the basis of New Zealand currency rates at the date when payment is made.

ADDITIONAL FEES
Late return fee
Failure to return the Vehicle at the agreed time and/or day will incur a late fee of $150 per day payable in addition to the daily rental rate for each day until the Vehicle is returned.
Waste Tank fee
A charge of $50 per tank applies if the waste tanks are not empty at the time of return.
Smoking
Smoking in the Vehicle is prohibited. Any evidence of smoking in the Vehicle will incur a cleaning fee of up to NZD1,500,000.00.

PICK UPS & RETURNS
Rental Location
Auckland and Christchurch .
Hours of Operation
Monday to Saturday 8am - 5pm (Open Sunday by request & bribes)
Closed Christmas Day and Boxing Day, New Years Eve and New Years Day

Vehicle Pick ups
19.1 - Collection point will be at the airport or your hotel in Auckland or Christchurch, free of charge.
19.2 - The Hirer acknowledges having received the Vehicle in a clean condition, with a full fuel tank and full bottles of gas.
19.3 - All Vehicle pick-ups and returns are to occur within WML's normal hours of operation except where special arrangements have been made.
Vehicle Returns
20.1 - The Vehicle must be returned at the time stated in the hire contract.
20.2 - Late returns will incur an additional fee (see clause 14).
20.3 - The Vehicle must be returned to the destination stated in the hire contract except where special arrangements with WML have been made. Changes may be subject to a charge of up to $500. The Hirer will be notified of the amount at the time the change is approved.
20.4 - The Vehicle is to be returned with a full tank of petrol. Failure to do so, will result in refill charges.
20.5 - The Vehicle is to be returned in a reasonably clean and tidy condition or a cleaning fee of up to $150 will apply
20.6 - All vehicle equipment, including but not limited to that stated in clause 2, must be accounted for and undamaged. The Hirer is liable for any equipment that is damaged or not accounted for.
20.7 - All holding tanks, including the toilet's holding tank, must be empty on return otherwise a cleaning charge will apply.

USE OF THE VEHICLE
The Hirer shall not:
21.1 - Sublet or hire the Vehicle to any other person
21.2 - Permit the Vehicle to be operated outside his or her authority
21.3 - Operate the Vehicle, or permit it to be operated in circumstances that constitute an offence by the driver, which relates to driving or attempting to drive with excess breath or blood alcohol or under the influence of drink or drugs.
21.4 - Operate the Vehicle or permit it to be operated to propel or tow any other vehicle
21.5 - Operate the Vehicle or permit it to be operated for the transport of more than the number of passengers specified in the Vehicle's certificate of loading.
21.6 - Drive or permit the Vehicle to be driven by any person if at the time of driving the Vehicle the Hirer or other person is not the holder of a current driver's licence appropriate for the Vehicle.
21.7 - Allow the Vehicle to be damaged by:
Submersion in water
Contact with salt water
Creek or river crossing
Driving through flooded areas
Beach driving

21.8 - Involve the Vehicle in any race, speed test, rally, or contest
WML has the right to:
22.1 - Terminate the hiring and take immediate possession of the Vehicle if:
The Hirer fails to comply with any of the terms of this agreement or if the Vehicle is damaged.
The Hirer has obtained the Vehicle through fraud or misrepresentation.
The Vehicle appears to be abandoned.
The Vehicle is not returned on the agreed return date or WML reasonably believes that the Vehicle will not be returned on the agreed date.
WML considers, on reasonable grounds, that the safety of the passengers or the condition of the Vehicle is or has been endangered.

22.2 - The termination of the hiring under the authority of this clause shall be without prejudice to the other rights of the owner and the rights of the Hirer under this agreement.

Minimum Age
All drivers must be 25 years of age or older, hold a current valid drivers licence, and to be produce it on request at the start of the hire.

Driver's Licenses
24.1 - Hirers must have a current driver's licence from their home country or an International Driving Permit (IDP).
24.2 - If the foreign licence is not in English, an English translation, or an IDP must be carried with the foreign driver licence. Foreign driver licences are valid for one year from the visitor's arrival in New Zealand.

Road Restrictions
Vehicles may not be driven on Ninety Mile Beach. Vehicles may be driven on any other designated roads.

Traffic Offences
All fines and fees imposed on any driver of the Vehicle during the hire period as result of breaches of the traffic laws are payable solely by the driver in question and not by any other party. Wilderness Motorhomes reserves the right to pass on the the hirers home contact details to the New Zealand traffic authorities.
Lost Keys. The hirer is responsible for the cost of replacing lost or misplaced keys. The replacement cost is 425.00NZD. (we're so sorry they are so expensive)

Animals
Animals, except for registered guide dogs and goldfish (must be kept in a sealed container for the duration of the hire period) are not permitted in The Vehicle.

ACCIDENTS, DAMAGE & BREAKDOWNS
Mechanical Repairs
28.1 - Puncture and tyre repairs are the responsibility of the Hirer unless the tyre is found to be defective.
28.2 - The Hirer will be liable for any cost arising out of the incorrect use of fuel or contamination of fuel or freshwater tank.
28.3 - Repairs to the Vehicle of up to $100 may be carried out without authorisation from WML and will be reimbursed upon presentation of receipts at completion of the hire. Where contact was impractical or impossible then repairs are permitted provided the repairer certifies in writing to you that he has tried to contact WML, could not and the repairs were essential to enable the vehicle to get on the road legally within a reasonable period. Payment in the first instance to be made by the Hirer.
28.3 - No responsibility for out of pocket expenses, accommodation charges or meals resulting from a breakdown or accident will be accepted. WML's liability extends only to the refund of hire charges for any full days of Vehicle use lost due to a mechanical breakdown.
Accidents
29.1 - If the Vehicle is involved in an accident or if any damage is caused to the Vehicle, WML must be notified within 24 hrs or as soon as practicable in order to give WML the opportunity to rectify the problem during the rental. Failure to do so may compromise any claims for compensation.
29.2 - If the Vehicle is damaged to the extent that it cannot be driven, WML will endeavour to exchange the Vehicle however, the availability of an exchange Vehicle is not guaranteed. Provision is subject to availability, client location, accident liability and remaining hire duration.

RELEASE AND INDEMNITY OF WML
The Hirer releases WML, its employees and agents, from any liability to the Hirer (regardless of who is at fault), for any loss or damage incurred by the Hirer by reason of rental, possession, or use of the Vehicle.
